

| The pain of not being able to see your children can be unbearable. The children want to see you, however, the other parent will not allow it. The solution is court ordered visitation. Visitation is set up with the best interests of the children as the paramount consideration, keeping in mind the rights of the non-custodial parent and the objective that parent and child should have as close and loving relationship as possible, despite the fact they may not live in the same house. Restrictions on the visitation rights of the non-custodial parent must be supported by evidence demonstrating that the child would be harmed in some way absent the restriction. Overnight visitation with the non-custodial parent is the rule, not the exception, indeed, a non-custodial parent is presumptively entitled during reasonable times to overnight visitation with the children. |
